Death of family member

My Grandmother passed away, March 2006, with the cause of death being cervical carcinoma on the death certificate. She was in pain for over a year before the doctor did any further tests other than saying it was arthiritis. When the doctor finally decided to do a scan he found a tumor and had it removed and sent off. It took over 6 weeks for the biopsy results to come back according to the doctor. Then, when it was officially determined to be cancer a board had to determine what was to be done. When they finally decided to do something it was too late. Do I have a case to pursue?

I am sorry to hear about the death of your grandmother. With failure to diagnose cancer cases, there are many issues to look at. A detailed look at all of the medical records is necessary to determine if negligence took place; also to see if the negligence was a direct cause of the death; and to determine if an earlier diagnosis would have led to a longer survival. To add to the other response, we do not know if YOU have a case. The authorized representative of the estate will have standing and authority to proceed with a grandparent's claim. You do not have standing merely because it was your grandparent.
