Legal Question in Medical Malpractice in Georgia
drug prescriptions
I was treated for a prescription drug addiction. After receiving my medical records, I realized my physician prescribed drugs too frequently.
Do I have a case?

Re: drug prescriptions
Under Georgia law, a physician may be liabile for medical malpractice if he deviates from the applicable standard of care during his treatment of a patient, thus causing the patient damage. In your case, it must be shown that your physician deviated from the standard of care of other doctors within his speciality by "over" prescribing or mis-prescribing prescription drugs to you. There should be standards for the frequency and amount a particular prescription drug should be taken by a patient. If your physician deviated from this stanard without a reason based on sound medical practices, he may be liable for damages due to your subsequent addiction. I hope this answers your question.
