Legal Question in Medical Malpractice in Georgia

Failed back surgery

My husband had back surgery in June 2007 to fuse L5/S1. Since the surgery he has been in worse pain than before. We went to another surgeon to see if there was anything that could be done to relieve his pain and after additional tests they said that there wasn't anthing that could be done. The hardware they put in is what is causing his pain. That it was in lack of a better term to big and it can't be removed due to the risks involved in the surgery to remove it. He could die on the table. Do you think we have a case against the surgeon that performed the surgery? Any advise would be welcomed. He is in constant pain and doesn't even go out of the house. His pain levels are at 5 or 6 on a good day.

More information is needed to determine if there is a possible case. You should also note that Georgia has a two year statute of limitations, which means that you must file suit with an affidavit of an orthopedic surgeon attached before June 2009, or you will be forever barred from pursuing this.
