Legal Question in Medical Malpractice in Georgia
medical malpractice??
brother went to ER with severe symptoms of headache to the point couldn't hold head up, discomfort in arms, weak legs, advised ER dr of all meds, allergies and medical conditions including diabetes. ER dismissed case as miagraine return to work in 2 days, f/u with primary dr. Didn't run any tests or do blood work-up. Wife asked about tests, Dr replied it wasn't necessary. Brother actually had stroke due to extremely high blood sugar caused a blood vessel to rupture, lost vision in one eye and partial vision in the other. Damage is not repairable. Does he have a case? Thanks

It may depend on when the malpractice occurred. Assuming it was after 2/16/05, it is more difficult to have case against ER because of tort reform, which provided ER doctors with immunity from ordinary negligence cases. You now have to prove gross negligence by clear and convincing evidence which is a tough standard to prove. If you want to discuss it further feel free to call.
