Prescriptions Given But Not Needed
My 13 yr old stepson was treated for ADHD since he was 5 & living w/ his Mom. Has never been tested since, until now. A psychiatrist had given him 3 meds, according to what his Mom told Dr. was happening at home, but HE was never questioned or given the chance to explain his side of things. He came to live with us 7 months ago, we recently had him tested by another psychiatrist, & was told he does NOT need ANY meds at this time. The 1st doctor had him on 2 types of ''speed'' & an antipsychotic med. His Mom has a history of mental problems, & we believe she coaxed the 1st doc into prescribing for him as she (Mom) thought he should be. Is there any recourse against the 1st psychiatrist or his mother at this time? Yet another psychiatrist has told me that his 1st doctor has a known history of personal problems & a history of mistreatment of patients. Doc #1 also refused to answer questions we had about his meds & told us our ''time was up'' & she had other patients to see. Not something a parent wants to hear when their child is being treated with strong meds!!! Help!!!

Because of the great expense involved in prosecuting a medical malpractice claim, not every claim will warrant the time, trouble, effort and expense, required to pursue it. Yours sounds like such a claim.
Normally, I will not recommend pursuing a claim unless there are very serious and permanent injuries to the victim. I do not see any injury which meets that definition from what you have described.
