Legal Question in Medical Malpractice in Georgia

Can I Sue For Physicial Damage & To Have License Removed

I can't seem to find a attorney to take my case against a former Dr. I have all the records of his negliance to myself and others. He has been in front of the Medical Board 3x's and is currently on probation until 4/2005 for writing Rx's for Loratab & other narcotics on suspension. During this time(1999-2002), why it took me that long. He gave me so many pain killers I ended up addicted. He caused more injury to my back, he never requested my past med. records and never took any MRI's or X-rays. My kidney ended up damaged and I wonder if it was a result of all of the meds he had me on for 3 yrs.

Can I sue him for malpractice and have his license removed as he is still practicing? Why can't I find an attorney to help me with this pro-bono. He is still insured. I have done all of the footwork and collected all of the records, information and files against him?!! Can someone help me?!!

Re: Can I Sue For Physicial Damage & To Have License Removed

Simply stated, you have waited too long to be able to proceed in a situation which spans 1999 to 2002. There is a two year statute of limitations and a five year statute of repose. I am very sorry, but it appears it will be up to one of his other victims to bring him to justice.

As to the pro bono issue, in cases where there is a viable malpractice claim, most cases can be handled on a contingency basis. I believe this is what you meant to say in the first case.

Sorry I can't be encouraging.
