Army College Fund/ MGIB

I enlisted and scored well on my ASVAB so I received 33,000 in Army College Fund as well. After being honorably discharged, I enrolled in school and attempted to collect my funds. Instead of receiving my MGIB with ACF lumped together, I received an amount just over 33,000. I was told that the ACF amount was a minimum that I could receive after the two were combined. It says nothing of that in my contract so I filed an injustice with the Army Review Board. They ruled against me, even though the Advisory ruled in my favor, on the grounds that they found insufficient evidence that I did not know of the difference before enlisting, assuming my recruiter told me of the difference. I gained a copy of the recruiter's handbook and a direct line from it states ''No attempt will be made to describe or provide the applicants a breakdown of the MGIB and ACF amounts.” Pretty scummy but the question I have can I file a case on the grounds of passive fraud? if not what would be applicable in this case? Any help is appreciated as I fight against big bad uncle sam.
