Legal Question in Military Law in Georgia
army discharge in AIT
I am in AIT and have been in some trouble. I tested positive for cocaine, and on another test for amphetamines. I was involved in an aggravated assault and have been diagnosed with depression, anxiety, and an adjustment disorder. Will I be discharged for this?

Re: army discharge in AIT
You could be discharged for any of these areas, or you could be sent to a court-martial. A court-martial is a military criminal trial and you could be charged with use of drugs or aggravated assault and face jail time as well as a punitive discharge. If the command does not decide to take this to a court-martial, you could be given a bad discharge (OTHC) for any of these acts. Before you sign or say anything, be sure that you speak with an attorney who can help you and make sure that you do not say or do anything which could be used against you or to receive a worse outcome. These are VERY serious charges so protect yourself by speaking with an attorney about your options and rights.
