Legal Question in Military Law in Georgia

discharge upgrade

I was discharged from the Navy in 1983 with a general under other than honorable discharge due to misconduct. I was attached as a missile tech on a sub they based my discharge on a preservice marijuana waiver and my failure of a urinanalysis. I also have and honorable discharge in 1980 when i reenlisted. My conduct since my discharge has been flawless. I am now pursuing a career in public safety and my discharge keeps disqualifying me. I need help, surely there must be something i can do?

Re: discharge upgrade

Since it's been more than 15 years since your discharge, you will need to attempt to have your discharge changed through the Navy Board for the Correction of Military Records (as opposed to filing for a discharge upgrade through the Navy's Discharge Upgrade Board). The Board will correct your military records only if you can prove that you are the victim of error or injustice. I recommend you seek an attorney to help you.
