When recieving a DUI, does the soldier have to give his chain of command the keys to his vehicle? Or does he have the right to keep his keys and just not drive his vehicle?

Re: DUI in Military
This question comes up every so often. The bottom line answer is, no, the command cannot lawfully order you to relinquish your keys. Your keys are your personal property and cannot be seized. The command CAN order you not to drive your vehicle, of course, and a violation of said order would be considered a violation of the UCMJ (Art. 92). Before you go asserting "your rights", you might should consider seeking the assistance of a civilian or military justice attorney to chime in on your behalf.
