Re: Marrying a Foreigner

Under the constitution the federal government must give "full faith and credit" to documents issued by the states. That's why your TX driver's license is valid in GA. Here, your marriage is valid anywhere and everywhere. The issue for you will likely not be the validity of the marriage, but rather, the immigration status of your spouse.

In order to qualify for an ID card and similar documentation, your spouse may have to demonstrate his citizenship. Non-US citizens who are spouses of US citizens (e.g., a German wife of an American solider) still receive an ID card, but there are certain steps that must be taken with regard to citizenship status before the couple returns to the US. In this instance since the status of the spouse was illegal before the marriage, you need to work with your command to find out what needs to happen to clarify and fix the status of your spouse.

Good luck.
