What should I do?
On the 18th of March I fell down a flight of steps as a result of a broken step inside my apartment. The maintainance/property managers of my apartment complex failed to repair it properly. What they had done was covered the broken wood with the carpet to hold it in place. As a result when I went to go down the steps the carpet and the stair gave way and I fell. I was not seriously injured in the fall but I do however have alot of bruises and muscle pain in my hip, lower back, neck and shoulder. I took pictures of the step to show that the wood on the front of the step was broken and that the step itself was not connected to the frame of the staircase. I have not gone to Doctor. Should I go and get checked out so that it is on file that I did in fact suffer these injuries as a result of the fall? What are my rights in a case like this? Is there anything that I need to do to protect my rights?

Fortunately, it sounds like your injuries were not serious. This flip side of this is that you may not have much of a case for damages. In addition to the pictures, I would get a friend who knows construction to come out ASAP and examine the step and make detailed notes. You have two years in which to take legal action. If your injuries worsen, you have plenty of time to put your case together.

On the issue of defects, landlords (LL) are responsible for known but not unknown defects. If the defect is unknown to all, including LL and Tenant (T), you would have to show the LL could have discovered it in the exercise of reasonable diligence.
