Legal Question in Personal Injury in Georgia

I am 51 yrs old and I fell in April walking normal down my daughters side walk due to the fact of sweet gum balls and it was around 11p.m at night and my granddaughter witness it and had to help me up, When I fell I try to catch myself and jam my wrist and felt like my shoulder and neck was kinda in a major cramp at the time, along with a huge scar on my knee still. But my daughter's house was in foreclosure at the time and still is, I was currently going to the doctor monthly anyway for refills for my medicine because of R/A, so I assume the pain I was feeling was just normal. Well now my knee has really been given me fits as well as my arm, neck, hand elbow and lots of numbness in my hand as well as being able to lift heavy items, But this didn't start with knee until I fell. So I had X-rays because I applied for my Disability in March and they sent me to there doctor and requested X-rays, well it showed according to the results that I look as if I have been in a car accident with my neck, and it also said I have Degenerative Disk Disease, Also the X-rays show the spacing in my neck , Do you think I should turn this in to the insurance company? Will this effect my daughter in any way? Thank you Darlene

There is some possibility of a legal claim depending on the detailed facts of the fall, and if there is a legal claim, an insurer may be liable. The issue will be whether the balls are an Act of God or if leaving them there was negligence (which may be affected by how long they were there). Based solely on your post I tend to think there isn't a claim, but since it is a possibility, you should see a lawyer immediately. Bear in mind a delay in making a claim may eliminate a valid claim. (Also, even if there is no or minimal negligence, the insurer may cover the medical payments depending on the policy).
