Accident at show
I took my children to an antique tractor show that I think is sponsored by the city. ''They had an antique buggy that was being pulled by a tractor and were giving free rides. The driver asked us if we would like to ride. I asked him how much it costs and he said it was free. My 3 children and I got in the buggy and we started around the property. We got almost all the way around and started to go up a hill. When we had almost reached the top of the hill the hitch snapped and down we went. There was a steep bank and a swift creek (since there had been
storms that morning) right behind us so we were bracing to go in the
water. There was a corvette between us and the water so we hit the corvette instead. It hurt the corvette pretty bad and Thank God my kids seem to be okay. My son's elbow was cut and hurts. I hit my knee really hard on the steel and went to the hospital to get it checked out. They said it's not broken but Iam in a knee immobilizer. They want us to meet them today because they said they need my hospital bill. Should I go? Thehospital didn't give me a bill yet and I think they just want me
there to sign something. Found out hitch was homemade wood w/no safety chain. have pics, police report. Do Ihaveacase?

You should contact an attorney as soon as possible, as you are required by law to give the city a formal ante litem notice of claim within 6 months of the incident, or you will be barred from pursuing a claim. From your initial description, you probably have a good case of negligence against the operator and organizer. If the city was responsible, you may have to file an ad litem notice (which has a shortened statute of limitations). I would not attend any meeting or sign any documents. Any statements regarding your injuries (or children) may be used against you in the future.

You should not meet with the City as they probably want a statement from you which could damage your chances of collecting for your injuries and pain and suffering. You don't know at this point what the extent of your knee injury is so there is no need to discuss it with the City.
