Auto Accident
My daughter's fiance was involved in a rear-end accident. It was raining and he was the number one driver on the report. The other person was ''injured'' (he drove him self home and did not go to the hospital). His seat broke and he claims he injured his back. There is a family friend who said he seat was broke before the accident. Since the accident he has been seen doing strenuous activities by several people even my future son-in-law who he is sueing. He did not file the insurance company as the defendant but we took it to the insurance company. Should this evidence be brought up or let it lie so the insurance company will pay these people off instead of coming after us?

Yes, you should tell the insurance company all relevant information. In fact, you have a duty to do so.

The insurance company should take your claim and defend it or pay out as they see fit. In the course of this, they should investigate the claim, but it is their case either way.
