Legal Question in Personal Injury in Georgia

Buggy Banged

74 year old male released buggy and damaged my car. Police came and told him that he was responsible, but he thinks the store should pay. He says that he is not going to pay. I attempted to sue but was told that he can't be made to pay because of age and income sources(social security). Can my insurance company fix my car and then sue him for the money and collect regardless of income sources.

He may be judgment proof, based on assets, income, and source of income (not age). There is really no way to tell from here. If you use your insurance, just let them handle.

Whoever told you that you can't sue is misinformed. You can file suit in small claims court. However, colleting any judgment might pose a problem. You should consult with a local attorney.
