Legal Question in Personal Injury in Georgia

Condo Rules & ''By-Laws''

Our condo association has a rule that if you are behind on your condo fees that your vehicle will be towed. This happened to me. I'd like to know what the law in regarding this matter. I thought they had to go through legal means, i.e. liens, forclosure, lawsuits, to collect. If they they can take my car for failure to pay condo fees, what is to keep them from taking any of my other property? Am I not, as an owner, entitled to park my vehicle on the property, which (unfortunately) the association owns. This, to me, seems to be a case of conversion. Any help would be appreciated.

I represent a number of HOA's in typical subdvisions but I don't represent any condo associations. I realize that the condo law is somewhat different, but I doubt that they have the authority to remove your vehicle. If you would like to discuss this matter further, please give me a call.
