Legal Question in Personal Injury in Georgia

fall and injury in a dept store

My 8 yr old son was following my wife through a department store. He was walking in between to display shelving units and around a pole and his foot caught the bottom shelf and it flipped up and cut his leg in three places. None of the cuts required stitches but the top cut did cut deep enough to leave a scar. His wounds were dressed at the store and I had taken several pictures with my cell phone. The stores insurance company is now saying that I must turn in all medical bills to my home owners insurance. Is this correct? and I really was not pleased with the attitude of the store and their insurance on this matter.

thank you for your time.

Re: fall and injury in a dept store

The store may not feel it is liable for the bills or that it has a duty to proceed further. We can't guess whether the store was at fault based on your post - certainly, most stores' have displays that will fall if kicked or hit by a child. That does not mean the store is liable. While some stores may have insurance that generally pays for such injuries, whether or not they are at fault, we can't guess whether this store does. The bottom line is that they don't have to agree with you about the accident or claim.
