Can falls out bottom of bag, landing on toe

20 oz can of spray fell out the bottom of large-retail,grocery store bag. They've (claims adjuster for insurance of the bag makers) have asked for me to send bag in (to be tested), pictures of toe (wasn't broken but has caused much pain, toenail will come off, another grow back within a year) and all medical expenses. I want to be compensated for pain (wasn't able to walk for 4 days) and the inconvience of it all (toe-nail falling off, going to doctors, etc.). Toe is still discolored, has blood clot. Claims lady is pushy and rude. Any advice?

First, get your checkbook ready. This is going to be expensive. Even getting copies of test results can be costly even though you aren't paying for the test. Anyway, once you send the bag off it will be forever and a day before you hear anything back. If you are serious, you need to retain your own attorney so you will be in charge of testing, etc.
