Legal Question in Personal Injury in Georgia
hello,
In May 2011, I fell on some type of liquid that was spilled on the floor at an airport. When I fell I hurt my back and leg. I notified the appropriate authorties when the accident happened. I had to go the ER when I reached my destination due to my knee being extremely swollen and hurting. Then a couple of days later I had to go to ER for extreme pain in my back. I saw a doctor for my back for months and now Ortho has told me after a MRI was done that I am going to have surgery on my knee. Currently my doctor bills are approximately $35000.00. This does not include surgery nor rehab. The company that is responsible for the airport incident has accepted responsibility. My question is: How is pain and suffering figured into the equation. I know that they cover the doctor expenses, but I am not sure how to address the pain and suffering issue. Is there some sort of formula that is used to determine an approx. amount? Thank you.

This is a question better left to a professional. You should retain a lawyer (if you have not already done so). Your attorney should be versed in the varying methods used to approximate your damages.

Best of luck,
If you have not already gotten a lawyer get one. Insurers will try every trick they can to not even pay the medicals, and they rarely pay pain and suffering to pro se plaintiffs as they know you lack the skill to take them to a jury trial.
A good lawyer will maximize your recovery. There is no magic formula for pain and suffering. Many cases involve 2-3 times the medicals, but the nature of the injury, future limitations and life-long effects, and even which insurer and which adjuster can change things.
Since you have NOT finished treating, it would be inappropriate to make any demand yet and you should have had NO discussions with the adjuster yet (and remember that every pro se statement you make will be recorded and used to reduce your damage award, so make NO statements without counsel!).
You have another problem. Your statute of limitations could run before treatment finishes and unless suit is filed, you would then get zero. So get a lawyer now. If you do not have one feel free to call my office 404-768-3509).
