Legal Question in Personal Injury in Georgia

If someone hits your vehicle and agrees to pay for the cost of the damages - are you obligated to use the money to fix your car? If you decide to trade the vehicle in before they pay you the money - are they still obligated to pay for the damages that occured to your property?
