Legal Question in Personal Injury in Georgia

Injured Child

My child, age 7, was at a ballpark in April 2004 and sitting on the top bleacher. He was doing nothing but sitting there and fell through the bleachers about 6 1/2' directly head first into pavement. He suffered a concussion. My problem is the medical bills, should the ball association be responsible for my childs injury and bills? He was not a player, just a spectator. They have not paid yet and I am receiving threating letters for payment. Thanks in advance for your advice.

The ballpark may indeed be liable. However, that is impossible to address in this type of forum because certain issues need to be examined, e.g., ownership of the park, insurance, design of the stands, etc. You should consult with a local attorney as soon as possible.

In most cases like you mention, if the design of the bleachers is standard and the possible hazards obvious, there may be no claim at all. However, there are cases of this sort where a claim might be made.

To determine if there is a claim, a lawyer would need details. Pictures would be very useful at a first appointment. If you have waited since April, you have really waited far longer than you should have to talk to a lawyer, and you need to do so as soon as possible (the right to a claim runs out with time, so delay can prevent a recovery altogether).
