Legal Question in Personal Injury in Georgia

Need legal direction

I was injured in a accident by a county sheriff. The county said they are sorry that the accident happend to me and does not want to take responsibility. They also state that they had to counsel the sheriff involved on his carelessness.

What are my rights once the opposing side doesn't want to be responsible?

You need an attorney. The county will continue to deny liablity unless forced to pay.

There is a doctrine in the law called "governmental immunity" which is too complicated to discuss here. It is the kind of thing that is very fact intensive as to when or if it applies and appeals court judges very often write legal opinions on this topic disagreeing with each other. You need an experienced attorney who understands this legal area. Frankly, most lawyers do not. Get a lawyer soon and be sure he/she is someone experienced in cases against county and municipal governments. A good place to start would be the city attorney of your town or the county attorney of a county other than the sheriff's county. Ron Lowry

Most cities and counties in Georgia require you to file an Ad Litem Notice with that municipality within a short period of time following the accident date. (for example: City of Atlanta requires the notice be filed within 6 months). If you fail to file the required notice, your claim will be barred by law.
