Legal Question in Personal Injury in Georgia

I was mobilized by the army and sent to a different state. I left my vehicle to my fiance that was only insured in my name. An illegal hit her car and totaled it. The illegal had insurance on his vehicle from progressive. Progressive was stating they wanted to wait til they here his side of the story, his statement, before paying anything, even though we have a police report showing that it was his fault and witnesses. Progressive eventually then said they will not pay us anything. Is it possible to get the check for the car from them?

First of all, if you left the vehicle with someone else and did not add her to teh insurance, you messed up badly. If you had done that right and had full coverage you would be fine right now.

Since you didn't (and allowed her to break the law and drive uninsured), you have a problem.

Who is liable does not depend on just a police report. If you feel he was at fault then you may need to get a lawyer and sue.
