MVA Injury...don't know a reasonable settlement
My 15 year old daughter was in a MVA on 3-17-00. She was a front seat restrained passenger in a car which was hit from behind. The car in which she was riding was totaled. She experienced neck pain and was diagnosed with cervical whiplash. She had to quit playing tennis on her high school tennis team, and had to stop running, and has had to stop virtually all of the fun things (which involved physical activity) since the accident. Now, following physical therapy and 4 months of excercising to rebuild the injured muscles in her neck, she is better though she still suffers at times with neck pain. We are ready to settle with State Farm Insurance Company (I think) but don't have a clue as to what a reasonable settlement would be. I would appreciate some guidance in this matter. Thanks so much.

Without knowing more about the details of her injuries, and her prognosis for long term recovery, it is difficult to evaluate the value of her case. Be advised, however, as Glenn mentioned, that State Farm is notorious for failing to give parties their full and just settlement. I would need to have our staff evaluate her prior and future injuries, and what needs to be done to allow her to be able to start doing those fun things again. It's a tragedy for a young girl not to be able to enjoy her life to the fullest. Additionally, depending on what the policy limits are, there may be other insurance policies that apply. Generally, you should not accept anything less than 3 to 5 times special damages.

If you have not already settled this case, be forewarned that State Farm is very difficult to settle. Most of my cases with them go to court and through a trial. I would be happy to review the records in your case and give you an honest evaluation. If you have settled already I would be interested in how much they offered you.
