Legal Question in Personal Injury in Georgia

Neck injury and no help

I was involved in an automobile accident 2 months ago. The other driver admitted fault and the wreck was written up as such. I have suffered 2 ruptured discs in my neck. I am self employeed with no medical insurance and 2 small children at home. I have been out of work since the injury and have had to struggle to pay for doctor visits, medictions, etc, as well our regular bills. My doctor says surgery is necessary (my right hand goes numb) and I can't afford it or get an offer from his insurance company. Please help!

I too beleive that you need to seek the advice of an attorney. However, i would want more information. Did the other driver have insurance? How much? An attorney can demand this information for you prior to filing suit. Did you have insurance that provided uninsured motorist coverage? What were the limits of that insurance? You can get this information from your own policy declarations. What are your medical bills? Have you given them to the insurance company?

Your situation is like that of many of my clients. Unfortunately, you must find some way (friends, family, church, donations, whatever) to "stay the course" until your case is ripe for settlement. The only alternative is to accept the pittance the other driver's insurance company may offer you as a nuisance settlement.

Any answer we give is subject to the TERMS on our web page. The answer that Mr. Field gave you is correct. Unless you are willing to accept a small nuisance settlement from the ins. carrier of the man who hit you, you will need to obtain a local PI lawyer, sue the other driver and then WAIT 18months or more for the real value of your case. Depending on the county you file in, the wait may even be longer. Hugh Wood
