It is possible to bring a claim and recover. Our law firm has done so previously.

It is more likely favorable outcome if the cause is a car wreck, a fall, or some other type of trauma.

Medical malpractice is always a challenging set of facts.

For specific legal advice, you'd have to contact a lawyer seeking representation.

Please accept my sincerest condolences for the death of your child. If a fetus dies as a direct result of trauma under Georgia law there is a potential claim for wrongful death of the fetus. The cause has to be either intentional or negligent trauma. There may be liability insurance coverage issues if the trauma was intentional. This type of case requires an attorney who is an expert at insurance, personal injury and wrongful death cases. If you go to a lawyer who does wills, DUI cases, etc. he/she will screw it up. Do not assume that just because someone says they are an expert in that area of the law that lawyer really is--look them up! Also, please do not contact any of those TV lawyers. The truth is they couldn't try their way out of a wet paper bag and really don't do anything but try to settle your case with one telephone call for about 10% of what it is really worth. Good luck to you.
