Legal Question in Personal Injury in Georgia

Property Damage

I was traveling to work on I-285 Westbound, when a box came off the back of a company truck and hit my windshield and my hood before falling on the interstate, and my windshied and hood were both damaged. I contacted the police while pursuing the vehicle to get the tag number and any other information visible on the truck, and filed a report. I also contacted the company and they initially said they would channel it through their insurance company, and I received two calls from them, but now they will not return my calls. Someone had removed the box from I-285 by the time I returned from getting the vehicle information, and I have not been able to find out who removed it from the interstate. What can I do to file a lawsuit against the company for the damages that my vehicle sustained in addition to the emotional stress caused by this incident?

I would recommend speaking with an attorney before taking any action. Filing a law suit can be complicated and you want to do it right from the beginning. If your damages total less than $15,000, you can take them to magistrate (small claims) court without an attorney.

You are entitled to file a civil suit for damages against the owner of the truck. You will have to file this suit in the county of the business or the county of the registered agent if the business is incorp. I do not know enough about the case to evalutate the probably success. You would be advised to have an attorney.

As far as the "emotional stress" ... the long and short is that you will likely never recover for it without some type of "evidence" of your physical damage ... i.e. .. medical bills.
