Rear-Ended in Auto Accident What Are My Right's?
On 2-11-00 I was a restrained driver in an auto-accident and rear-ended. This was where I wa stopped at a yield sign and the other driver hit me. There was very minor damage to my rear end of my car. Her front bumper of her car was damaged moderately. Iwas restrained but raised forward in my seat looking left at traffic so as to proceed. But she hit my car and I felt immediate pain in my neck and back. Taken by ambulance to ER at hospital. Doc said this was neck and back whiplash?Seen 2 times by primary doc and now by ortho. so I am still under treatment by ortho. and to undergo physical therapy.My concern is how do I proceed as far as her insurance and a claim and what can I expect from a pain and suffering standpoint as far as compensation. I do feel better and I feel like the Phy. Therapy will probably help a great deal. So what do you think I should do ? Thank You For Your Help!

You have a fair MV PI claim against the other driver. The reason i say fair is that in these type of small collision soft tissue injury cases, the insuarcne company always low balls. Which insurance company is it?

Low impact, low-property damage, soft tissue injury motor vehicle collision cases are systematically low-balled by the main personal lines automobile liability insurance carriers. While there can be substantial long-term ramifications in terms of myofascial pain disorder or the deterioration of an intervetebral disc, there is seldom much for a jury to see and comprehend. I have gotten some pretty decent verdicts and settlements on these cases, but they are so labor-intensive that I have stopped accepting employment in these except as a favor to someone to whom I am really indebted for some reason. You need a lawyer with 5+ years of relevant experience, but who is not yet so far along that s/he feels ready to turn down cases that aren't catastrophic. Alternatively, I sometimes mention that one may consider a small claims proceeding in magistrate court, which in Georgia has jurisdiction up to $15,000.
