Legal Question in Personal Injury in Georgia

Remedy For Injuries Caused By an Uninsured Motorist

The individual who caused the accident during which I sustained injuries so severe as to lose two weeks work, did not have insurance. (Apparently the individual showed the police officer a current insurance card. The individual's insurance company said the insurance was cancelled 20 days before my accident. Of interest and this is straight from the insurance company, the individual renewed her policy exactly 2 hours and 45 minutes after the accident.) Nonetheless, I've been told by others that an attorney probably would not take this case on a contingent fee basis. I've also been told that an attorny may take it because of something to do with the insurance company issuing a ''reservation of rights''? letter. I am at a loss as to what to do and would appreciate any help anyone could provide.

Youneed to read your own insurance policy. Do you have Uninsured motorist coverage? if you do, your own insurance company acts as the insurer for the negligent uninsured driver. Many people reject uninsured motorist coverage without realizing it. I carry 1,000,000 UM coverage because it will be the dead beat uninsured driver that is most likely to cause grievous injury to myself or my family.

Thanks for your inquiry. Unfortunately, you could not give enough facts in your email to permit me to give you a worthwhile recommendation. However, some issues to think about are: (1)is there any uninsured motorist coverage available to you? (2) does the at-fault driver have any assets you're aware of which could be subject to a judgment? Please feel free to call me at 770-640-6558 if you have any questions whatsoever.
