Where can I review cases & settlements about head injury?
We would like to research previous cases like ours. Simply put, my wife was hit in the head by a rock thrown from a lawnmower. We currently have an attorney and are proceeding to file suit since they will not settle for what we believe is fair given the total loss and pain and suffering that my wife and our family has suffered due to their negligence. I am having a hard time finding cases, judgements and settlements on the web that will allow us some further degree of understanding as to what is reasonable for us to expect and settle for in this case. Can you direct us to web sites that might list cases of this nature?

We practice in GA and run a web site devoted to GA law. However, you will not find the cases you need on the web. They are all in pay areas like Westlaw or Lexis. Sorry about that.
You can drive to Georgia State University or Emory University and research in the law library for free. However, they type of law you are searching for is quite well known by even the worst of PI lawyers.
You have not disclosed enough facts to answer your question specifically, however, you have 2 years from the date of the suit to file against the person or homeowner operating the lawnmower. Suit may only be brought against the lawnmower manufacturer (which I do not suggest) if the lawnmower is less than 10 years old.
The only real damages are those your wife suffered. The other damages against you (consortium) and against your family, are really about worth zero). Unless, we are talking about a horrendous injury where your wife was hosp. for a long time.
If the injury is not severe, you might consider 3 to 5 times her actual medical costs to be a good starting point to consider resolving her claim. If, however, you are seeking a million dollars, you will undoubtely have to try the case.
Jury verdicts vary greatly in GA. The same case tried to a Fulton State Jury may bring $100,000 in Fulton State and $25,000 in Gwinnett or Cherokee County.
I am aware that you have a lawyer and you should seek counsel from your attorney. the best method i know of searching prior settlment is by paying ATLA Exchange to do it for you.thye have a database compiled by informaytion for members. ATLA is the association of trial lawyers of america. Your lawyer should be a member. Also, WESTLAW has a settlment and verdict service but you have to have a westlaw password to use it.
