Settlement Question
My husband, 11 week old baby and I were involved in a car wreck on 7/12/00 as we were heading to Fla on vactation. A lady hydroplaned on I-75 and crossed 4 lanes of traffic and we T-Boned her. Our car was totaled, our vacation ruined, and we were bruised and banged up. We went to the doctor and he determined we had soft tissue damage and we have been in phy therapy up until 9/28/00, which we were released but advised to continue our "exercises" because we both still have some discomforts from time to time. Our baby, now 5 months old, has hated the car seat since the accident which we beleive is because of the loud bang the impact made.
We are ready to settle with the lady's insurance company and don't know what kind of settlement we should consider. Our lives have been greatly inconvenienced, it took me 3-4 weeks to feel comfortable getting back into a car without fear, and we have just now bought a new auto and not to mention the discomfort I encountered nursing my baby after the accident. Our medical bills are $4300...what would be a fair settlement.

There are too many variables involved in settling an injury case to give a blanket rule or formula for determining a settlement.
You need to contact an attorney to discuss all issues involved in your claims and make an appropriate settlement demand

I agree with Mr. Grantham's answer. Your medical records, both present and past, will need to be reviewed, along with the police report, before determining a value. Also, the at fault party's insurance policy limits need to be known because you may need to put your insurance company on notice of a potential UM claim. Please see an attorney so that you do not become the next victim of the insurance company.
