Legal Question in Personal Injury in Georgia
slip and fall lawsuit
I want to settle, my lawyer wanted to file suit; he filed suit. Now, he mailed me discovery request that I'm not interested in adhering to nor am I wanting my case to proceed any further toward court day, so I mailed him a certified letter telling him that he was fired and that I wanted in writing confirmation that he no longer represents me and that he file a notice of withdrawal from the court. Medical bills are around 25,000.00. My wish is for me to contact the defendants attorney and try to settle amiable. What are my chances of this getting done and bringing closure to my case? (I intend on paying my x-attorney what I owe him for his fees and services that were rendered before firing him to be backed out of the payment from the settlement.) If everything goes as I hope it will,do you think that this road that I want to go down can be obtained and finally settled and brought to closure? I thank anyone for their advice. Again, Thank you.

Re: slip and fall lawsuit
It was probably a foolish move to do what you did.
Since no one here has access to your bills, records and fee agreement, we can't answer what you would owe the lawyer, but if he filed suit it was likely because the case was worth more in his opinion than the offer, and he may well be entitled to a percentage of that larger amount.
Again, since no one here has any of the records and documents, no one here can predict more than the likelihood that you probably worsened your situation.

You may want to get in touch with him and negotiate in writing an agreed upon fee if you can.

Bad move. Now you are at the mercy of the insurer and its attorney.
Re: slip and fall lawsuit
You had a lawyer to answer questions about things such as your chances of an acceptable settlement. No one here knows anything about your case, and guiding you through a pending lawsuit is not the purpose of this forum. I expect the other lawyer will be happy to hear you fired your lawyer and want to settle yourself.
