Legal Question in Personal Injury in Georgia

statute of limitations

I was involved in an accident with a passenger. Afterwards, the passenger attempted to get money from my ins. company for medical bills, unsuccessfully. In turn, she is now suing me for a very large amount of money. I am wondering if the statute of limitations is up for this lawsuit.

Has the Statute of Limitations Expired?

Don't you think it would be helpful if you listed the exact dates? Without them, the Q cannot be answered.

In GA, the passenger has 2 years from the date of the accident to sue anyone or third party who hit the car your all were in. She also has 2 years from the date of the accident to sue you. She may have combined the suits and the suit against you was dormant until the other driver got out of the suit on Summary Judgment and that left the passenger with only the recourse to sue you.

When was the accident?

the statute in georgia is two years frm injury. You must nortufy yoyr ins co immediately if you have claim they will hire a lawyer for you

In GA, a person has two years from the date of an injury to bring an action for personal injury. However, a person has four years to bring a claim for property damamge. So, if more than two years have passed since your passenger friend was injured, then the statute of limitaions has run and the claim will be barred. So, even though he can still sue you, you can plead that the statute has expired.
