Being sued for medical bills, pain and suffering!

I was involved in a car accident, back in August of 2004, where I was at fault. I pulled out of a strip mall parking lot making a left turn. There was no traffic lights or stop signs so I preceded to make the left turn but out of no where a car hits me on the driver side. It was a bad wreck and I admit he had the right of way. I received a letter from the gentleman the other day July of 2006. It stated that he had an ankle injury resulting from the accident and that he was unable to work for one year. With the medical bills being so high he didn't believe that he should pay for something he didn't cause. My insurance liability pay out for person injured is $25,000. This gentleman states that it wasn't enough. He states that he is being fair to ask for $27,000 more for medical bills and lost of wages plus $5000 for pain and suffering. Then he states that being the nice guy that he is he is willing to settle for $20,000 medical bills and lost wages plus $5,000 for pain and suffering on top of the insurance pay out of $25,000. He says if I don't reply in a timely manner he has no choice but to seek legal actions against me. What should I do???

No one here can guess whether he will sue, what he has already received, or whether he has settled with the insurer and released any claims. The first thing you need to do, ASAP, is contact your insurer. You will need a lawyer if/when you get served with a lawsuit, but you may want to wait and see whether he will actual file suit. Ask the insurer about proving counsel for you if he sues.
