Legal Question in Personal Injury in Georgia

Totaled Vehicle Storage Fees Responsibity

My son was in an accident on Dec 9. We towed the car home that night and it's been on our business property

ever since. I have read that the insurance company is responsible for storage fees until a settlement is made. What is the law, and how much is it per day, and are they responsible?

Which insurance company? Your own or the other driver? Are you in the busniess of storing autos. If not, don't see how you can claim storage.

Re: Totaled Vehicle Storage Fees Responsibity

Assuming the other driver was at fault, he/she would be liable, usually covered by his/her own insurance company, for any economic loss you sustained. The key word here is "sustained". In your case you did not sustain any charges for storage and therefore cannot recover anything from the other driver.

It would have been different if your vehicle were repairable and storage fees were incurred at, say, the garage before the mechanic could get to it.

Since you only asked about storage, that is all I have addressed. There are other things the other driver would be liable for such as the reasonable cost of a rental vehicle between the date of the accident and the date of settlement.
