Legal Question in Personal Injury in Georgia
A tree fell on my room in a liscenced rooming house a month ago and the landlord knew about it and he the tree moved a week after. I have complained and have proof that he knew of the problem that there was still an open hole in the roof and my room. He did nothing. I called code enforcement and they found emergency violations yesterday. This morning I went over into the damaged area to open my closet door which agitated the already damaged ceiling and plaster and insulation fell on my head/face knocking me back onto my elbow pushing my shoulder out of the socket. The ceiling was already leaking way before the tree damage and I told the landlord about it. He did nothing. I'm sitting in the emergency room now to be seen about my injuries and to see if I have a concussion. Do I have a case?

I am sorry that you are hurt. It is very smart to be evaluated by a doctor for a concussion or any potential brain injury.
A landlord has the duty to make sure the property is safe. An individual has the obligation to avoid known risks and hazards. Your inquiry presents with a mix of responsibilities. Depending on your injuries, and the possibilities of long term injury, you may want to speak with an attorney further on the matter.
Good luck.
