Legal Question in Personal Injury in Georgia

Hi, I just went to trial for a traffic ticket and lost. I went to appeal the decision and when I went to the Court Clerk and asked for the audio recording of the trial for it to be transcribed, she showed me the tape and when she played the tape you could not understand anything because the audio was completely overwhelmed with static and so it is impossible to understand anything. So now I have no testimony to appeal with. Can I sue the city for gross negligence (i.e. not making sure the audio recording system in the courtroom was working)? This means I will probably have to go to a re-trial if I want to appeal, but it will cost me a lot of money because I live out of state from where I got the ticket and where the court is.

The lack of a transcript is your fault and no, you cannot sue the city. You needed a lawyer at trial. A lawyer would have told you to make arrangements at your expense, for a court reporter. City courts are not courts or record and don't have to do recordings at all.
