Under-Insured Motorist

What can a person do, if involved in a accident where the other party is under-insured, and you have to claim on your policy which has a $1,000.00 dollar deductable? The other person is not financially set to sue, I hate to hear that, it's our responsibilty to make sure our own vehicle, rentals, and any other expenses have to be collected from us, and the other party is out nothing except the vehicle he owns, due to it being totaled, when our expenses far exceed what his policy is. What can we do to help change the laws for motorist who aren't insured enough to cover their own property much less someone else's?

Well, I don't know about the "change the laws" part -- you can go down the General Assembly between January 1 and March 31 of every year and waste your time trying to change the law.

As for what you can do with regard to your question, you can pay your $1,000 deductible and recover the rest under your policy. You can sue the guy who hit you and get a worthless judgment.

That's about all the civil law allows as redress.
