Legal Question in Product Liability in Georgia

Poor Installation Damaged property

I purchased a replacement vinyl liner

for my inground pool in 2004. The

liner was installed in Oct. It was too

small. The dealer had measured

wrong. Between myself and the

dealer, he was convinced to replace it

with the correct size. Took about one

year. The second liner leaked! It took

me months to get the dealer to

replace it. He replaced in in 2007,

early summer. I again questioned

the positioning of the liner as I did

the previous one as it was not seated

properly and pointed out that it was

losing water. i was assured that it

was losing at a normal, acceptable

rate. I had to leave town for several

days and returned to an almost

empty pool. I again called and

complained. this time I found tears

in the liner where it was tearing

away from the steps. The dealer sent

someone to patch the tears. It still

leaked. i was informed that i would

be charged if i called again. I called

someone else and it was found out

that the screws at the steps were

spinning in stripped out holes. the

screws were replaced and it still leaks

at the steps. now there is no support

under the steps from washing away.

How should I word my suit against

the owner in Magistrate Court?

Your question is outside the scope of this non-confidential forum. If you have a substantial amount of money invested, then you should consider hiring an attorney to examine the evidence, and draft a pleading based on the facts and law.
