Legal Question in Real Estate Law in Georgia

90 Day limit?

We bought our home and were told we were on city sewer. Turned out we have a septic system that is failing. The sellers say they didn't know at first but now agree to put in the drain lines that are needed and have the tank pumped. They have to wait past 90 days after we bought the house to do the repairs. Is there a limit on the time they are liable? At first they only agreed to pump the septic but now agree to do the repairs. We are trying to be agreeable but cautious.

Re: 90 Day limit?

The 90-day waiting period is unexplained by the information that you offered. There may be legal theories available to the seller(s) that could make it difficult for you to recover from them. You should employ an attorney to review the relevant information about your home purchase transaction and subsequent dealings with the seller. A lawyer could also draft an agreement that would attempt to insure that the sellers fulfill the promise. Call me in the event that you wish to pursue representation.

Get their agreement in writing, if you have not done so. It is unlikely you need to pay a lawyer an hourly fee to review all the documents and draft new ones, given that they are willing to pay.
