I want to add a name to a deed to my house, but the person is married. How can I exclude this person's spouse from my deed?

A lawyer can draft the deed. But honestly, this is potentially a dangerous idea, as if that married person dies, his spouse will likely inherit his share, and in a divorce, she may have claims to it.

Additionally if money is owed on the property, you may violate the loan deed and trigger the debt being called due in full.

You also may have federal gift tax issues.
