How to appeal a foreclosure ?
I beleive I have been a victim of predatory lending.My
mortgage company would not work with me. I have been unemployed for 11 months.I have live in this house since birth,and also raised my grwon daughter here.
i have approx 60,000 in equity byt the mortgage company
auctioned my house on Oct 7. I cant lose this house!
What are my options?

Based on the limited information I can't help much. I appreciate your sentimental concern for the house but what you have is a business situation. What I can say, is that generally the loan company does not have to work with you. If they "work with you" and make alternate payment arrangements they could violate the terms of their own note and make it difficult to foreclose legally. Foreclosures could be appealed by filing an action in the Superior Court, but you would have to prove that they foreclosed illegally, which would usually involve some sort of process violation. Most lenders hire experienced attorneys who understand the process very well. Being out of work and having no money would not allow you to stay under any circumstance. Contact Georgia Legal Services and they can get an attorney to work with you and explain what has happened. What you can hope for is that they sell the house for fair market value and that you would actually get some money out of it. That is where an attorney might be able to help. Contact the new owner and see if they might work with you on a rental basis for now. Maybe later you will find work and be able to purchase it back.
