Condos have their own set of rules as set out in the Code. However, in single-family detached dwelling subdivisions, there are no requirements that the association be incorporated. However, as a practical matter, in "swim-and-tennis" subdivisions, the developer usually incorporates the association so that at the appropriate time there is a legal entity to whom he can transfer title to the land on which the amenities are located.
