Legal Question in Real Estate Law in Georgia
Auctioned Property
We owned a home in GA and feel behind on payments because of job displacements. The house was listed with a realtor and there was actually a contract on the home for a pending sale. When the realtor contacted our mortgage company informing them of the pending sale, they refused to accept the offer even though it was enough to cover the outstanding balance. They proceeded to inform the attorneys in Atlanta to auction the property in court.
Now the prospective buyer wants to charge us for inspection fees etc they paid.
Do we have any options in this situation?

Re: Auctioned Property
Only if the buyer knew the property was being foreclosed upon when he contracted to buy.
