Bad title search

In 2004 purchased a property with apparent clear title. In 2008 discovered title was not clear during refinance and previous owner still has 50% ownership rights. Made significant improves to land & home (+600k). What recourse do I have to closing attorney & seller for fraudulent sale? Can seller place conditions on property before he signs (property rights?), if he signs? Closing attorney recommended I NOT get title insurance. It was not necessary. Need advice..very large investment

As you say, it is a large investment. That means you see a real estate lawyer who can review the documents and facts, rather than message board advice.
