Legal Question in Real Estate Law in Georgia

Cemetery on Private Property

My husband and I have lived in our house for almost 9 years now. When we first moved here, a couple of people came to our house to ask about the small cemetery in our backyard, but none have been here since then until today.

Our neighbor just realized one of his family members is buried in the cemetery. Our property completely surrounds the cemetery and we really do not want them coming on our property - they are very untrustworthy. The only way to get to the cemetery is to come up our driveway and walk across our backyard.

What grounds do we have legally to prevent them from accessing the cemetery whenever they want to?

What constitutes an ''abandoned'' cemetery?

Any other advice would be appreciated.

That is a very serious issue -- beyond the scope of this forum. You really need to get a lawyer to guide you through anything you do, prior to upsetting family members and making the 6:00 news. If they are "untrustworthy" now, wait until you try to cut them off from the gravesites. Your "abandonment" theory won't fly for gravesites.
