City's responsibility in billing error

I purchased my house in 2005 with the sellers marking down on the disclosure that it was operating on a the city sewer system. Come to find out 2 years later that I actually have a septic system that is in need of serious repair. I contacted the sellers and they said that they were being billed for sewer by the city so they didn't know there was septic. When I talked to the city they said they've been billing my address for sewer for many years. The repairs are amounting to $5,000+ and I want to take the city to court to have them pay the costs since everybody has been going by their records. Do I have a case? I see them as the responsible party since everyone for years has been looking at their records, which are incorrect and now are costing me a lot of money.

If I read correctly, you think that because the city mistakenly billed for sewer, they somehow became liable for repairs to a septic system they obviously did not have anything to do with. That is a far-fetched theory. Your defective septic system, presumably on your property is costing you a lot of money. Not the city. Request a refund of any fees YOU have paid since you purchase the house and/or request a hook-up if possible.
