Legal Question in Real Estate Law in Georgia

Civil Action Lawsuit

My husband and I canceled a pursuit to purchase a new home in 8/2007 because in the end we felt we wouldn't be able to afford it. We ended up buying a house $30,000 less and now the Realtors have sued us for the entire commission. Do they have a case? What are the potential repercussions for a default judgment on this civil action suit...What steps should I take?

Re: Civil Action Lawsuit

You fail to mention the information that matters - the terms of any agreement you had with the realtor. This is something that should have been understood in the beginning. The same goes for any contract for the purchase of the property. Without this information, no one can guess who has a case, and who does not. You have been sued - get a lawyer well in advance of the deadline. The lawyer should be experienced in handling real estate litigation - not merely one who claims to handle many unrelated areas of law.

You need to have your contract with the agent and the seller reviewed by an attorney.

It would not be appropriate to discuss your action in this non confidential forum. You need to consult with an attorney. Your best answer will come after the individual who you select has an opportunity to review your contract with the real estate agent.
