Legal Question in Real Estate Law in Georgia
Civil Suit against Construction Business effecting other Property
A fraudulent civil action was filed against our company regarding placement of a new home on a vacant lot in an old subdivision - we have received all permits from City/Co. gov't and the house is complete, buyer has moved into, but can't close on the home until this is resolved. We have 4 other houses currently under contract and today a mortgage company told us they could not close on a ''non-related'' peice of property across town since our company had a pending civil suit. Is there any legal basis to this claim by the Mortgage lender? How can this civil suit effect any other properties when there is no judgement against us, no liens, not even on the associated piece of property?

The first thing you need to do is make sure a timely Answer is filed to the lawsuit. The next is to contact an attorney who can review all the relevant documents. I cannot give you a reliable answer without having the benefit of reviewing these documents.
